Assumption of Risk Clause

I acknowledge and understand that my participation (or granting my child/dependent to participate) in services provided by Silent Disco by JCQ Jones LLC and associated affiliates is voluntary. I acknowledge and understand the scope, nature, and extent of the risks involved and expressly, voluntarily, and irrevocably assume any and all risks of loss and/or damage to property, illness, injury, and/or death arising from my participation, whether or not contemplated in this Agreement and regardless of how it was caused. Understanding these risks and the potential for others not listed, I agree to personally accept and assume all of the risks present in my participation with Silent Disco by JCQ Jones LLC. By signing this document as the Parent/Legal guardian of a participant under the age of 18 years, I personally accept and assume all risks present in the individual’s participation.  I approve my child to participate fully and listen to all music tracks provided by Silent Disco by JCQ Jones LLC. 

 

 

Participation Risks Associated with Health and Safety Compliance 
I acknowledge that the unstructured nature of freestyle/improv dance may involve rapid, unpredictable movement. I will avoid dangerous maneuvers or movements that may injure myself or others around me during the event.  Participants acknowledge inherent dangers, including but not limited to slips, trips, falls, physical exertion, or injuries arising from dance, particularly on uneven or outdoor terrain when applicable. I acknowledge that dancing outdoors involves inherent risks, including but not limited to uneven, slippery surfaces, insects, and exposure to weather elements, which may cause injury (when applicable). I further state that there are no health-related reasons or problems, which preclude or restrict my participation in this activity, and that I will pay any medical costs that may be attendant as a result of injury to myself. I acknowledge, understand, agree, and represent that I understand the nature of the activities to be undertaken and that I am qualified, in good health, that I am not impaired from the influence of drugs or alcohol, and in proper physical and mental condition to participate in such activities. I further agree and covenant that if at any time I believe that my participation would put me or other participants at risk of harm, I will decline to participate. If I participate, I do so voluntarily and knowingly and I expressly assume any and all risks of property damage, personal injury, and/or death to me or other participants arising from my participation. I acknowledge and understand that I am fully responsible for managing myself, my actions and my emotions in connection with my participation, and am solely responsible for all of my actions and speech. Silent Disco by JCQ Jones LLC offers wireless headphone rentals with procured music playlists of various music genres and is designed for entertainment purposes only. If I have any concerns or questions about my health, I should always consult with a physician or other health-care professional.  I understand that Silent Disco by JCQ Jones LLC does not assume any responsibility for or obligation to provide financial or other assistance in the event of injury or illness, including but not limited to medical, health, communicable disease risks, dental, orthopedic, or disability insurance or support.

 

  

Equipment Liability

Wearing headphones can reduce perception of the surrounding environment and hazards. I assume all possible risks related to malfunctions or misuse with the rented equipment. I assume risks of wearing headphones that can produce loud music which can lead to hearing damage. I understand that I am responsible for controlling the volume level on the provided headphones to ensure my own safety and comfort. I acknowledge wearing of earrings, hair accessories, headwear, or hearing aid devices may cause bodily damage or may cause damage to such devices; we encourage you to remove all such items prior to using headphones to minimize this risk. I agree to hold Silent Disco by JCQ Jones LLC harmless from any discomfort or injury (physical, mental, and emotional) associated with rental of our products and participation in the event(s). 

Release of Liability and Indemnity
I personally, as the participating client, intending to be legally bound, do hereby, for myself, my heirs, executors and administrators, irrevocably release, discharge and agree to hold harmless Silent Disco by JCQ Jones LLC their subsidiaries and affiliates and each of their respective managers, directors, members, shareholders, officers, agents, employees, representatives and volunteers (all of the foregoing being referred to herein as the “Released Parties”) from any liability whatsoever for any and all claims of any nature which may arise out of or relate to me and my attendance at, participation in or association with movement, dance and related events, or other activities held at, sponsored by or in which Silent Disco by JCQ Jones LLC participates or during any Silent Disco by JCQ Jones LLC activity or event (i.e. fundraisers, public venues, etc.) taking place at any private or public venue. I acknowledge that Silent Disco by JCQ Jones LLC and affiliates are not responsible for any injury, damage, or loss (including personal, private or public property) resulting from the use of the rental equipment, services, or use of venue facility. Under no circumstances, including, but not limited to, negligence, shall Silent Disco by JCQ Jones LLC, it’s subsidiary, doing business as (DBA’s), contractors and parent companies or affiliates be liable for any direct, indirect, incidental, special or consequential damages that result from the use of, or the inability to use, the services, even if Silent Disco by JCQ Jones LLC is advised beforehand of the possibility of such damages (because some states do not allow the exclusion or limitation of certain categories of damages, the above limitation may not apply to me. In such states, Silent Disco by JCQ Jones LLC liability and the liability of its subsidiary, DBA’s and parent companies or affiliates is limited to the fullest extent permitted by such state law). To the extent that statute or case law does not prohibit release for negligence, this release is also for negligence on the part of the Silent Disco by JCQ Jones LLC. If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to the invalid, then the remained of this release from liability shall remain in full force and effect and the offending provision or provisions severed herefrom. I will agree to follow any rules and policies set in place by the public venue business or organization which are not detailed in this document. I will not hold these entities responsible for stolen, damaged, or loss of personal property.   I specifically acknowledge and agree that Silent Disco by JCQ Jones LLC is not liable for any defamatory, offensive or illegal conduct of any participant. If I am dissatisfied with the service or any policies applicable thereto, my sole and exclusive remedy is to leave or discontinue use of the services. As a participant and equipment renter, I agree to indemnify Silent Disco by JCQ Jones LLC against all claims, lawsuits, damages, and costs (including legal fees) arising from the use or possession of the equipment or services provided.

Media Release and Intellectual Property

I fully consent for Silent Disco by JCQ Jones LLC to publish videos, films, photographs, interviews or any other images and/or media of me and my involvement (or consenting as the parent/legal of a participant(s) less than 18 years of age) in activities or events and consent for the publication, broadcast or other use of the images and/or words for promotional purposes without compensation to me. 

All content on our website, including logos, text, and images, is the property of Silent Disco by JCQ Jones LLC and may not be used without notarized permission.

 

In Summary

I have read this waiver of liability and fully understand its terms. I understand that by signing up, attending and/or participating in freestyle movement and silent disco events (public or private), or any event or program, current or future, organized by Silent Disco by JCQ Jones LLC at any location or online, I hereby agree to give up substantial legal rights, including the right to sue Silent Disco by JCQ Jones LLC and acknowledge that agreeing to this waiver voluntarily, without any duress or coercion, and I intend it to be a complete and unconditional release of all liability.  By signing this release, I acknowledge that I understand its content and that this release cannot be modified orally. I also acknowledge that Silent Disco by JCQ Jones LLC reserves right to dismiss anyone not abiding by these rules, regulations and policies.
